Bill on the Decriminalisation of Abortion for Pregnant Women

On 12 June 2019, the National Council adopted Bill No. 234 on the decriminalisation of the voluntary termination of pregnancy.

The purpose of this Bill was to amend Article 248 of the Criminal Code in order to remove criminal penalties for women who decide to have an abortion.  In addition, the Bill provided for a more flexible situation for health professionals, who would then be allowed to give advice to their patients or refer them to a colleague abroad.

The Prince's Government wished to examine this proposal without delay.  It has carried out extensive consultation on this matter, including with the Women’s Rights Committee.  After in-depth analysis, undertaken in a positive spirit, it adopted the proposed guidelines in the form of a bill, while specifying, in the heading, that decriminalisation refers only to pregnant women.

In line with the concern expressed by the Assembly, the Government considered that this text would provide an appropriate response to the distress of pregnant women, who would no longer be convicted, but heard and supported, while preserving such basic values as the unborn child's right to life and the principles of the State religion.
