Plenary Session of the Commission for the Updating of Codes

The Commission for the Updating of Codes has resumed its activities, on the initiative of the Department of Justice.  In this respect, it met in a plenary session on 9 April, chaired by Mr. Laurent Anselmi, Director of Justice.

This Commission, in which various players in Monegasque law are represented, was created by a Sovereign Decision of 26 May 1954.  Its mission is to undertake codification work over the long term.  To be effective and serve the rule of law, it brings together representatives of the three constitutional functions - legislative (National Council), executive (Department of Justice, Prince's Government) and judicial (the Courts, Public Prosecution Department and the Bar) –from which eminent specialists are drawn.

This first session was an opportunity to identify all the wishes of those present, then, after an initial exchange of views, two working groups were created, the first dealing with civil procedure and the second with criminal procedure.  These groups will have to work on drawing up provisions on a precise list of technical points, to be submitted to the next plenary session of the Commission, which will take place in the early autumn.  Ultimately, the aim is to draft "turnkey" bills, with a view to initiating legislative procedure that is facilitated by the specialised work carried out beforehand by this Commission.
