Information Meeting on the Implementation of the New EU Regulation on Personal Data Protection

On the initiative of the Prince's Government, an information day on the implementation of the EU's new regulation on the protection of personal data was held today.  Meetings were held for representatives of the main Monegasque economic players in the private sector, followed by meetings for representatives of the public sector, the parapublic and institutional entities, chaired respectively by Gilles Tonelli, Minister of Foreign Affairs and Cooperation and H.E. Mr. Serge Telle, Minister of State.  These presentations on the General Data Protection Regulation (GDPR), the issues involved and its impact on Monaco were given by Mr. Alain Bensoussan, a lawyer specialising in the law on new technologies.

The GDPR is the new European framework for the processing and dissemination of personal data.  This text, which will apply from 25 May 2018, standardises the personal data legislation of EU Member States.  It aims to give all EU residents more control over their personal data and make those who are responsible for and process this data more accountable, while reducing preliminary formalities with regulators, and strengthen the role of the Data Protection Authorities.

 Although it is a third country to the EU, the Principality is concerned by the provisions of this European Regulation.  The GDPR is applicable, in particular, to companies established outside the EU that process the personal data of natural persons residing in the EU, with regard to the supply of goods or services by these businesses.

It should be recalled that Monaco has incorporated data protection rules in its domestic law since 1993.

In this new context, "the modernisation and adaptation of Monegasque legislation to the new European rules is one of the priorities of Government action and work is already under way in this regard," Gilles Tonelli explained.

The Minister of State, for his part, emphasised that there is "an opportunity that the Government wishes to seize, through several important projects:  the development of the smart city;  the strengthening of our digital ecosystem and the implementation of a real strategy on these subjects, including the appointment, a few weeks ago, of an Interministerial Delegate who is responsible for Digital Transition."
